1. INTRODUCTION

These Terms of Service (“Terms”) govern the access and use of the website www.kaamguru.in and related services (collectively, the “Platform”) operated under the name KaamGuru (“Company”, “we”, “our”, or “us”).

By registering or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

2. NATURE OF PLATFORM (INTERMEDIARY STATUS)

KaamGuru is an online marketplace and technology intermediary platform within the meaning of the Information Technology Act, 2000.

• Merely facilitates interaction between independent Hirers and Workers.
• Does not employ, contract, supervise, or control any Worker.
• Is not a party to any agreement between Hirer and Worker.
• Does not guarantee quality, safety, legality, or completion of any work.

KaamGuru qualifies as an intermediary under Section 2(w) of the Information Technology Act, 2000 and claims safe harbor protections under Section 79 of the Act, subject to compliance with applicable law.

3. DEFINITIONS

• “Hirer” means a User who posts work requirements.
• “Worker” means a User who accepts and performs work.
• “User” means any person registered on the Platform.
• “Services” means facilitation services provided by KaamGuru.

4. ELIGIBILITY

• User must have legal capacity to enter into a binding contract under Indian law.
• By registering, User confirms compliance with applicable laws.

5. ACCOUNT REGISTRATION & VERIFICATION

• Registration is free of charge.
• Users may register as Hirer, Worker, or both across multiple categories.
• A valid Indian mobile number is mandatory.
• OTP-based verification is required for account activation.
• User is solely responsible for maintaining confidentiality of login credentials.

KaamGuru shall not be liable for unauthorized access due to User negligence.

6. WORK POSTING & ACCEPTANCE PROCESS

1. Hirer posts work under relevant categories.
2. Workers can view category-based listings.
3. Worker may accept a work listing.
4. Upon acceptance, Hirer’s contact details become visible to the Worker.
5. Hirer and Worker independently negotiate terms (price, timeline, scope).
6. Upon completion, Hirer may mark work as completed and provide rating/feedback.

KaamGuru is not involved in negotiation, payment, supervision, or execution of work.

7. NO EMPLOYMENT OR AGENCY RELATIONSHIP

• Employer-employee relationship
• Partnership
• Agency
• Joint venture

Workers are independent service providers.

8. USER OBLIGATIONS

• Not to post illegal, fraudulent, misleading, or harmful content.
• Not to impersonate any person.
• Not to violate any law in India.
• Not to misuse contact details obtained through the Platform.
• Not to harass or threaten other Users.

Violation may result in suspension or permanent termination.

9. DISCLAIMERS

• Does not verify credentials, qualifications, or background of Users.
• Does not guarantee work quality or payment security.
• Is not responsible for disputes, damages, injuries, fraud, or losses.
• Is not liable for any direct, indirect, incidental, or consequential damages.

Users use the Platform at their own risk.

10. LIMITATION OF LIABILITY

• Loss of profits
• Loss of reputation
• Data loss
• Personal injury
• Third-party misconduct

11. CONTENT & SAFE HARBOR COMPLIANCE

Users are solely responsible for content posted. Upon receiving actual knowledge of unlawful content under applicable law, KaamGuru reserves the right to remove such content without prior notice.

12. TERMINATION

• For breach of Terms
• For unlawful activity
• If required by law enforcement
• At our discretion to protect platform integrity

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India. Courts located in Hansi, India shall have exclusive jurisdiction.

14. MODIFICATIONS

We reserve the right to modify these Terms at any time. Continued use after updates constitutes acceptance.
